A Propped-Open Pool Gate Can Cost More Than Four New Pool Fences

In Queensland, leaving a pool gate propped open carries a maximum penalty of more than $23,000, the Queensland Building and Construction Commission says. At Going Rate's prices that is more than four and a half compliant pool fences, and more than the fence, a heat pump and a resurface put together. The inspections that catch a broken barrier cost less than one pool cleaning visit, from $150 for a first inspection at Woollahra Council in NSW to at most $78 a year in Western Australia. Tree removal follows the same pattern, with a $98 City of Sydney application set against a $3,000 on-the-spot fine in NSW.

TL;DR
  • Queensland's maximum penalty for failing to keep a pool gate closed, including propping it open, is more than $23,000, the QBCC says, more than four and a half times a compliant pool fence ($5,000) at Going Rate's prices.
  • In Victoria, failing to maintain a pool safety barrier carries up to 50 penalty units, listed by Hume City Council at more than $9,600, nearly twice the price of a compliant pool fence ($5,000) at Going Rate's prices.
  • A first pool barrier inspection costs $150 at Woollahra Council in NSW, about 45% of one pool cleaning visit ($330) at Going Rate's prices, and Western Australia caps the annual inspection charge at $78.
  • A compliant pool fence ($5,000) costs about 7.5% of an inground pool ($66,500) at Going Rate's prices, yet more than 7 in 10 of 1,840 Lake Macquarie pool inspections in 2018 found the pool did not comply with NSW safety law, the Newcastle Herald reported.
  • NSW's on-the-spot fine for illegal tree clearing is $3,000 for an individual, about 91% of a professional tree removal ($3,300) at Going Rate's prices, while a City of Sydney application to remove a tree costs $98.

The pool fence fine is bigger than the fence

A compliant pool fence ($5,000) is one of the cheaper items in a pool build. In Queensland, failing to keep a pool gate securely closed when it is not in use is an offence, and the Queensland Building and Construction Commission says that includes propping the gate open. Section 245T of the Building Act sets the maximum penalty at 165 penalty units, which the QBCC put at more than $23,000 in March 2024. That is more than four and a half fences at Going Rate's prices.

That maximum is more than the fence, a pool heat pump ($6,000) and a pool resurface ($10,000) combined, which come to $21,000 at Going Rate's prices, and more than landscaping a yard ($17,500). It is about a third of an inground pool ($66,500), and it would pay for about 70 visits from a pool cleaning service ($330), priced per visit. Queensland indexes its penalty unit, so the dollar maximum may now be higher.

Victoria and NSW set lower ceilings that still pass the price of the fence. Failing to maintain a pool safety barrier in Victoria carries up to 50 penalty units, Hume City Council's pool page says, which the council lists as $9,615.15, nearly two fences. Victoria indexes its penalty unit each year, so the current figure may be higher. The State Library of NSW's legal guide puts the NSW penalty for breaching outdoor pool barrier requirements at up to $5,500, about 1.1 fences. All three are maximum penalties. A court or council can impose less.

A compliant pool fence is a small share of the pool bill

At Going Rate's prices the fence costs about 7.5% of an inground pool ($66,500). Add a heat pump ($6,000) and the two come to about 16.5% of the pool. Add the first resurface ($10,000) and the three come to $21,000, nearly a third of the pool price.

Owners let the fence slip all the same. An analysis of 1,840 Lake Macquarie pool inspections in 2018 found more than 7 in 10 did not comply with NSW safety legislation, the Newcastle Herald reported, and more than 40% still failed on re-inspection. In Victoria, the Auditor-General estimated the state has 200,783 pools, found about 13% of them unregistered, and found owners had not addressed 49% of non-compliance certificates.

The City of Greater Geelong reports better numbers. Of its 8,904 registered pools and spas, 8,143, or 91.4%, held a current compliance certificate as at 25 August 2026.

Why the pool gate matters more than the fence price

Faulty fencing and gates that did not latch or had been propped open accounted for 90% of pool fatalities and life-threatening immersions of young children in Queensland from 2011 to 2021, according to a Sunshine Coast Council release citing a Queensland Family and Child Commission report. The same report found supervision was inadequate in 65% of early-childhood pool fatalities.

The QBCC says 40 Queensland children aged 0 to 4 drowned in regulated pools between 2011 and 2021, and 853 more needed medical attention after a non-fatal immersion. Nationally, Royal Life Saving's National Drowning Report counted 35 swimming pool deaths in 2024/25, 68% of them in backyard pools, Surf Life Saving Australia reported. In its summary of the 2025/26 report, Royal Life Saving Society Queensland says drowning deaths of children under five fell to 11.

The Sydney Children's Hospitals Network says NSW drowning risk is highest between 25 December and 2 January. A compliant pool fence ($5,000) needs a gate that self-closes and latches every time.

Pool compliance paperwork costs less than one pool clean

The checks that catch a broken barrier cost less than a single pool cleaning visit ($330). Woollahra Council in NSW charges $150 for a first barrier inspection, $100 for a second and nothing for later ones, and a Certificate of Compliance stays valid for three years. At Going Rate's prices the $150 first inspection is about 45% of one cleaning visit and 3% of the fence.

Western Australia caps the annual charge for its four-yearly barrier inspection at $78 under the state Building Regulations, the Shire of Gingin says, about 24% of one cleaning visit. The first inspection of a new pool barrier is capped at $312, re-inspections included. In Victoria, Hume City Council's published schedule lists $34.20 to register a pool and $21.90 to lodge a compliance certificate, together about 17% of a cleaning visit.

Skipping the paperwork costs more. In Victoria, failing to register a pool, or to lodge a certificate, carries up to 10 penalty units, which Hume City Council lists as $1,923.10, more than five cleaning visits at Going Rate's prices. In Queensland, the QBCC says a homeowner who buys a house with a pool without a pool safety certificate faces an on-the-spot fine of more than $2,000.

Pool running costs to price at install

A heat pump ($6,000) costs about 9% of the pool at Going Rate's prices, and a resurface ($10,000) about 15%. A pool cleaning service ($330) charges per visit, so a regular booking adds up across a swimming season.

Electricity is a steady bill. The federal energy.gov.au site says a pool pump can make up around 18% of the electricity bill, which can be more than a washing machine, clothes dryer and dishwasher combined, and that in a typical home with an in-ground pool the pool can be as much as 30% of the household energy bill. A 5-star variable-speed pump uses 55% less energy than a 1-star single-speed pump, according to the same site.

Covers cut both heat and water loss. Energy.gov.au says a bubble cover cuts heat loss from a heated pool by as much as 75%. Riverina Water says leaf covers cut evaporation by around 40% and security covers by up to 90%, and that backwashing a sand filter can use up to 8,000 litres of water a year.

Tree removal and sheds follow the same rule

A professional tree removal ($3,300) has its own paperwork trap. The NSW Planning Portal says the on-the-spot fine for illegal tree clearing is $3,000 for an individual. At Going Rate's prices that is about 91% of the removal, so removal plus fine comes to about 1.9 times the job. NSW has proposed making each tree removed attract a separate fine, with final changes planned for the second half of 2026.

Courts go further. Bankstown Local Court fined a Sydney developer $36,000 for removing four protected trees at Padstow Heights, City of Canterbury Bankstown says. That is $9,000 a tree, about 2.7 tree removals each, or nearly 11 removals for the lot at Going Rate's prices. A City of Sydney application to prune or remove a tree costs $98, about 3% of a removal, and Ku-ring-gai charges $88 for one tree in 2026-27. City of Sydney treats an application as refused if it has not notified the applicant within 28 days, so apply early.

A backyard shed with slab and approval ($14,300) raises the same question. In NSW a shed is exempt development only up to 20 square metres in most zones, or 50 square metres in rural and R5 zones, Armidale Regional Council's summary of the state code says. It must sit in the rear yard, stand no more than 3 metres high and be set back 900 mm from boundaries, or 5 metres in rural zones. Bigger sheds need approval, which Going Rate's shed price includes.

Pricing the whole backyard, legally

At Going Rate's prices, an inground pool ($66,500), its fence ($5,000) and a heat pump ($6,000) come to $77,500. Landscaping ($17,500), a pergola ($12,500), an outdoor kitchen ($26,500), a shed ($14,300) and a tree removal ($3,300) come to $74,100. That backyard totals $151,600, and the pool and its kit take about half of it.

That spend goes into smaller yards. The ABS found the floor-to-site ratio of new capital-city houses rose from 0.49 in 2012 to 0.56 in 2021, and described the result as similar sized houses with smaller yards. Roy Morgan found 14% of Australians, more than 3.1 million people, lived in a home with a pool or spa in early 2023, and the federal Energy Rating site counts around 1.1 million backyard pools.

The cheapest protections each cost less than one pool cleaning visit ($330). Register the pool, book the inspection, fix the latch and keep the gate shut. For trees, lodge the council application before anyone starts cutting.

Common questions

How much is the fine for a propped-open pool gate in Queensland?

The Building Act sets a maximum penalty of 165 penalty units for failing to keep a pool gate securely closed, and the QBCC says that includes propping it open. The QBCC put that maximum at more than $23,000 in 2024, more than four and a half times a compliant pool fence ($5,000) at Going Rate's prices. It is a maximum, and the actual penalty can be lower.

How much does a pool fence inspection cost?

Woollahra Council in NSW charges $150 for a first inspection, $100 for a second and nothing after that, and a certificate lasts three years. Western Australia caps the annual inspection charge at $78. Both cost less than one pool cleaning visit ($330).

How much can you be fined for a non-compliant pool barrier in Victoria?

Failing to maintain a pool safety barrier carries up to 50 penalty units, which Hume City Council lists as $9,615.15, nearly twice the price of a compliant pool fence ($5,000) at Going Rate's prices. Failing to register a pool or lodge a certificate carries up to 10 penalty units, listed at $1,923.10. Victoria indexes its penalty unit each year, so current amounts may be higher.

Is a heat pump worth adding to a new pool?

A pool heat pump ($6,000) costs about 9% of an inground pool ($66,500) at Going Rate's prices. Energy.gov.au says a bubble cover cuts heat loss from a heated pool by as much as 75%, so a cover reduces the heat the pump has to replace.

How much is the fine for cutting down a tree without approval in NSW?

The NSW Planning Portal puts the on-the-spot fine for illegal tree clearing at $3,000 for an individual, about 91% of a professional tree removal ($3,300) at Going Rate's prices. Courts can go higher, and Bankstown Local Court fined a developer $36,000 for removing four trees. A City of Sydney application costs $98.
